July 26, 1951. This is an appeal from a decree of the county court of Greenville County, awarding a mandatory injunction against the defendants, J.F. Welborn and J.F. Welborn, Jr., commanding them to remove certain buildings in process of construction on their adjoining lots, Nos. 3, 4, 5, 6, and 7 of Block A, in a residential subdivision known as Woodville Heights. The mandatory injunction was awarded upon the ground that the erection of buildings to be used for commercial purposes violated building restrictions applicable to these lots. It was stipulated by counsel for the case to be heard before the county court upon the pleadings, submitted affidavits, and all pertinent records of Greenville County. The parties will be referred to as plaintiffs and defendants.
